We will work hard to get construction defects permanently fixed so the
problem doesn’t come back. You should avoid band-aid or cosmetic approaches
that don’t solve the underlying problem.
It is best to avoid litigation. We advise homeowner associations and
individual homeowners to attempt to work out the problems with the builders
and developers first. But, after you have exhausted every other means of
getting the problem fixed, then we can help.
We strongly encourage settlement discussions involving round-table meetings
of construction experts in an effort to develop a reasonable repair plan
funded by those responsible for the construction problems. It’s almost
always better to avoiding the expense and delay of litigation. However,
sometimes the at-fault party simply refuses to acknowledge responsibility.
Then it’s essential to file suit and aggressively move the case forward, all the way
to trial if that’s what it takes.
